ARTICLE 1
Applicability
These Terms & Conditions apply to all offers, products, services, orders, agreements, and deliveries made through ArtebyQVAZ. By placing an order through the website, the customer agrees to these Terms & Conditions.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain fully applicable. ArtebyQVAZ reserves the right to amend these Terms & Conditions from time to time. The version published on the website at the time of purchase applies to that order.
ARTICLE 2
Nature of the work
HANDMADE & ARTISTIC
ArtebyQVAZ operates at the intersection of art, design, wearable art, and collectible objects. Offerings may include:
Wearable art and jewelry
Original artworks
Sculptures and objects
Editions and prints
Workshops
Made-to-order pieces
Commissioned works
Many works are handmade and may involve experimental, artistic, or manual production processes. Products may contain natural materials such as shell, stone, pearls, wood, or other organic elements.
Due to the handmade and artistic nature of the work, minor irregularities, asymmetry, tool marks, texture differences, colour variation, surface variation, and material variation may occur and are considered part of the character of the work rather than defects.
Product photographs are intended to represent the work as accurately as possible. Colours and appearance may vary slightly due to lighting, screen settings, and the natural character of materials.
ARTICLE 3
Orders and agreement
An agreement is concluded once the customer places an order and payment has been successfully completed. ArtebyQVAZ reserves the right to refuse or cancel orders in cases including but not limited to: obvious pricing or typographical errors; suspected fraud or misuse; production limitations; stock availability issues; or unforeseen circumstances.
If an order cannot be fulfilled, any payment already received will be refunded where applicable. Ownership of products remains with ArtebyQVAZ until full payment has been received.
ARTICLE 4
Prices and payment
All prices displayed on the website are in euros (EUR) and include VAT unless stated otherwise. Shipping costs are calculated separately during checkout.
ArtebyQVAZ reserves the right to correct obvious pricing mistakes or typographical errors. Payment must be completed through the payment methods offered at checkout. Orders are processed after successful payment confirmation.
ARTICLE 5
Made-to-order and commissioned work
Custom and made-to-order works are excluded from the right of withdrawal under Article 16(c) of the EU Consumer Rights Directive.
Certain works are made-to-order, customized, personalized, or commissioned specifically for the customer. Production begins after confirmation and/or payment. Once production has started, cancellation is no longer possible.
Custom-made, personalized, commissioned, or made-to-order works are excluded from the right of withdrawal and are non-returnable unless legally required otherwise or unless the item is defective.
ARTICLE 6
Processing and delivery
Orders are shipped from the Netherlands. Processing times stated on the website are estimates and not strict deadlines. Made-to-order works are shipped within the timeframe stated on the product page or order confirmation.
ArtebyQVAZ is not liable for delays caused by postal services, customs procedures, carrier disruptions, weather conditions, strikes, public holidays, force majeure, or events beyond reasonable control.
Customers are responsible for providing accurate shipping information. Additional costs resulting from incorrect addresses, failed delivery attempts, refusal of delivery, or uncollected parcels may be charged to the customer. Risk of loss or damage transfers to the customer once delivery has been completed, unless mandatory law states otherwise.
ARTICLE 7
Right of withdrawal (EU consumers)
EU — 14-DAY RIGHT
Consumers located within the European Union may have the legal right to withdraw from a purchase within 14 days after receiving the product. To exercise this right, the customer must notify ArtebyQVAZ within 14 days after delivery via email at contact@artebyqvaz.com. After notification, the customer must return the item within 14 days.
Returned items must be unused and unworn, complete, returned in appropriate protective packaging, and not show signs of use beyond what is necessary for inspection. The customer bears the direct cost of return shipping unless otherwise required by law.
The right of withdrawal does not apply to custom-made, commissioned, personalized, or made-to-order products. Refunds will be processed within 14 days after receipt of the returned item or proof of return shipment, whichever occurs first.
ARTICLE 8
Warranty and complaints
ArtebyQVAZ supplies products that reasonably conform to the agreement and the expected quality standards appropriate for handmade and artistic work. Customers must inspect products upon delivery and report complaints within a reasonable timeframe.
Normal wear and tear, oxidation, scratches, impact damage, misuse, improper storage, exposure to chemicals, moisture, perfume, cosmetics, sunlight, or accidental damage are not considered defects. If a complaint is found justified, ArtebyQVAZ may choose repair, replacement, partial refund, or full refund as appropriate.
ARTICLE 9
Precious metals and hallmarking
Where legally required under Dutch hallmarking regulations (Waarborgwet), precious metal items will be hallmarked accordingly before sale. Descriptions of silver, gold, or other precious metals are based on their stated metal content.
ARTICLE 10
Intellectual property
All artworks, designs, concepts, photographs, videos, texts, branding, and website content remain the intellectual property of ArtebyQVAZ unless stated otherwise. No content may be copied, reproduced, distributed, modified, published, or commercially used without prior written permission. Purchase of a physical work does not transfer copyright, reproduction rights, or commercial usage rights.
ARTICLE 11
Workshops and events
Workshop and event participation is confirmed after payment unless agreed otherwise. Participants must follow all safety instructions and participate at their own risk. Cancellations up to 48 hours before the event: rescheduling may be possible. Less than 48 hours before: no refund unless otherwise agreed.
ARTICLE 12
Liability
ArtebyQVAZ is not liable for indirect damages, consequential damages, loss of profit, emotional damages, or third-party damages unless liability cannot legally be excluded. Any liability is limited to the amount paid for the relevant order unless mandatory law states otherwise.
ARTICLE 13
Privacy
Personal data is processed in accordance with the Privacy Policy published on this website and in compliance with the General Data Protection Regulation (GDPR / AVG).
ARTICLE 14
Governing law and disputes
These Terms & Conditions are governed exclusively by Dutch law. Any disputes shall be submitted to the competent court in the Netherlands unless mandatory consumer law provides otherwise. EU consumers retain the right to use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
